In late August, I got hired to a day job working at a restaurant.
This job schedules me at inconsistent days and hours, which alters how I approach commissions.
Please check the schedule tab on the navigation for my work times and turnaround estimates regarding commissions.

Work Schedule

I work a day job at a restaurant that gives me long and inconsistent hours. Days I work on commissions are usually on off days or between off-days. It's updated every week as soon as I get access to my schedule.

DAY JOB SCHEDULE

October 9 to October 15

  • Wednesday: 5 PM to 11 PM

  • Friday: 12 PM to 8 PM

  • Saturday: 4 PM to 11 PM

COMMISSION DAYS

  • I'll work on commissions TUESDAY, WEDNESDAY and THURSDAY.

Turnaround Estimates

As per my Terms of Service, there is a four (4) month grace period for a completed commission.
This is in place so that I can:
Get a proper amount of sleep.
Have time for myself (avoid burn out).
Have at least one full, proper day off every other week.

My name is Jessie Clarey-Berthiaume. I’m a freelance artist located in Minnesota. When I’m not making art, I’m assisting my roommates with fostering various cats and helping them find good homes.I grew up watching lots of traditional animated films and shows. The way the crews took simple art techniques to create the illusion of life to 2D drawings has always been magic to me, and I strive to capture that and pass it forward in my work.

  • I will refuse commissions that do not agree with or show lack of understanding to these terms.

Payment


  • Payment is accepted by PayPal Invoices. USD Currency.

  • Payment is required before I work on your commission. I will not start until it is fully paid.

  • Do not send payment without my approval first. Any payment sent to me outside an invoice and without my approval will be sent back.

  • Cash, crypto, eChecks, check by mail and cash are not acceptable forms of payment.

- Client Cancellations & Refunds -

  • You (the Client) can request to cancel your commission at any time, for any reason.

  • Refund amount is reflected by how much work was completed on the piece.

  • If payment is not received within three (3) days of sending the invoice, and no word or agreement beforehand was given for it, your commission will be voided and removed from the Wait List.

  • Refunds are not given on commissions that have been completed.

- Artist Cancellations -

  • As the Artist, I reserve the right to cancel a commission or project at any time, for any reason.

Process


- General Commission Process -

I take a limited amount of commissions each time I open. These are called “slots” and you (the Client) get your name filled into one when you are accepted. There’s a specific process that goes into getting one.

  • I take commissions via Google Forms. They remain open for one (1) week and then I go through them and pick ones to accept. You are not guaranteed a commission slot by submitting a form. If you are not picked you can try again next time.

  • Clients selected are reached out via the contact method put on their form to discuss their commission. Once their slot is secured, they are added to my Trello waitlist. Once every slot is filled, I will begin working on commissions.

  • Clients do not pay until I'm ready to start their commission. I will approach via message before sending the invoice and will not start it until it is paid.

  • Limited WIPs are sent to keep things moving.

  • Once the completed piece is OK'd by the client, their files are uploaded and forwarded via Google Drive link or DeviantArt Sta.sh.


- Requirements on Order Form -

  • Your Email, to send the invoice. (Required).

  • Preferred contact method for updates. (Required).

  • Reference Sheet and/or Descriptions of your Character.

  • Reference Photos/Pictures and/or Descriptions of setting, mood, and tone of the piece.

  • Some general permission things, such as if you want it to be public or private/NDA, whether or not I am OK to stream, etc.

To ensure the accuracy of your commission, enter all necessary details within your Order Form. Artistic liberty and changes will be taken for areas that are not addressed. These details will be discussed before I begin your commission.


- YCH / Adoptable Process -

YCHs and Adoptables are released in sets and payment is taken upon sale. Adopt files are sent once the invoice is paid. YCHs are worked in a steady rotation after payment until every single slot is complete.

  • YCHs and Adoptables are first come first serve. It will be noted in the description post if I do holds.

  • Payment is taken upfront upon claim.

  • YCH batches are assigned to 'groups' and worked in rotation. Group A one day, Group B next day, and so on. WIP checks are sent when each YCH in a 'group' is ready for one. This ensures no one's YCH falls too far behind.

  • I resort 'groups' throughout the process based on client response time, so no need to worry about slow responders potentially impacting your own order.

  • Finished YCH pieces are delivered via Google Drive link or DeviantArt Sta.sh. Adoptables are also attached to the invoice sent out.


- Turnaround Times & Scheduling -

  • I work inconsistent days and hours at my day job (restaurant). As such, days I schedule for commission work can change from week to week. See the Schedule tab in the page navigation for my hours and turnaround estimates.

  • Turnaround time is usually within four (4) months unless deadlines or expectations are discussed. If something happens where they take longer than that, it will be communicated, and extra artwork or partial refunds may be offered to make up for the wait.

  • WIP checks and messages are responded to during work hours. If it is not an emergency, I will not reply outside of my work hours.

  • NOTE ON YCHS - The first few days of a YCH set are slow as they are mostly spent replying to inquiries and sending invoices. Wait at least three (3) business days. I usually start having updates for users then.

General


- Client -

You (the Client) are expected to read my Terms of Service and understand my Commission Prices.Below is a quick table of what may and may not do with your commissioned Artwork:

YOU MAY

  • Display the work on external sites, so long as it has visible credit to me.

  • Use the art for personal use, including (but not limited to): profile pictures and banners, phone and computer background wallpapers, and similar displays.

  • Create a physical reproduction of the art for personal use (NOT to sell).

  • Create reproductions of the art to sell PROVIDED mutual agreement of such has been reached beforehand.

  • Retain the rights to the character design of any adoptable purchased from me.

  • Make minor edits to the Artwork, such as cropping and filters.

YOU MAY NOOT

  • Claim the Artwork as your own.

  • Use the Artwork for redistribution and/or external projects, be they commercial or non-commercial (t-shirts, mugs, etc.) unless discussed and agreed upon with me.

  • Resell adoptable designs for more than you paid (unless it has more artwork to reflect its value).

  • Make major revisions or edits to the Artwork to the point it is unrecognizable, such as extreme recoloring or major edits to the piece.

  • Use the artwork in NFTs.

  • Use the artwork in AI image generators.

Any harassment in an attempt to bargain for a commission (a “slot”) is not tolerated. This includes inappropriately worded comments on my profile(s), email, private messages, and public social media and chat platforms.Clients who have commissioned me before these Terms went into effect are still bound by its contents.By placing an order and commissioning me, you agree to these Terms of Service and all its contents therein.


- Commercial Usage -

If you (the Client) wish to order a commission for Commercial use, the total price of the commission and any related royalties will be agreed upon upfront.
MINIMUM price increase is 300% of the original price (triple the base sum). I reserve the right to charge more if I deem fit, however.
The following is considered commercial use:

  • Reproducing and selling the Artwork (publicly or privately) on things such as merchandise (shirts, stickers, prints).

  • Situations where you receive profit from a medium or platform where you posted my Artwork (Patreon, Twitch, business cards, etc).

  • Artwork and designs used for games, films, or other mass media.


- Privacy / NDA Request -

  • A privacy request is made that I am not allowed to share WIPs or snaps of the piece anywhere and/or may not post it to my socials until a certain point or at all. This must be mentioned and discussed in the ordering process.

  • It is expected that you (the Client) also refrain from posting such spoilers yourself when making a privacy request.

  • NDA fee scales with the order at +100% the base price of the order. The bigger the work, the higher the fee.

  • I reserve the right to charge a fee if I deem it fit to do so.

If you want your commission to be private, then you must state so during the ordering process.

- Copyright -

  • I reserve the right to sign, watermark, and/or label my own work. I’ll send you a full resolution file (via Google Docs or email). You will get a version that is watermarked for public sharing and a version without for private use.

  • You are responsible for protecting ownership rights over designs made by me when uploading to other sites.

  • For commissions, I may use the Artwork to promote myself by posting it on websites or using it to attract more commissions. I will not, however, sell the work or use it for profit in any way.

  • For adoptables, rights to the design carry over to the buyer once transferred to you (the Client).

  • Unused sketches from your order or refunded, cancelled orders may be repurposed and resold to other clients in other commissions or as YCH.
